U Mobile Trade-In Offer
These Terms and Conditions govern the trade-in of the Device and are supplemental to any other terms and conditions that you will have with U Mobile (collectively, the "U Mobile Agreement"). If any of these Terms and Conditions conflict with any other terms and conditions in the U Mobile Agreement, the terms and conditions in the U Mobile Agreement will apply to the extent of the conflict. In these Terms and Conditions, "we" or "us" or "our" refer to U Mobile Sdn Bhd (223969-U).
  1. You are deemed to have accepted these Terms and Conditions when you provide us with the Device which you wish to trade-in by handing us the Device at our store ("U Mobile store"). Before providing us with the Device, if you have any questions relating to these Terms and Conditions please contact us via our website at www.u.com.my or by calling us at 6018 388 1318.
  2. You represent and warrant that:
    1. you are not under the age of eighteen (18);
    2. you are the sole and rightful owner of the Device and you have the rights and title to transfer ownership of the Device;
    3. the Device is obtained by you through lawful and legal means; and
    4. the Device is not counterfeit or pirated goods.
  3. If you trade in the Device which is still subject to an unexpired contract period whether with U Mobile or other service providers, you must pay your cancellation charges/fees in accordance with terms and conditions of the earlier contract before you are eligible to participate in this trade-in program.
  4. The quoted device trade-in value ("Quoted Value") will be determined by U Mobile or a third party based on the make, model, condition and operational nature of the Device. All Quoted Values are conditional and subject to adjustment by U Mobile or a third party on our behalf
  5. All trades are final once the Device is handed to U Mobile for trade-in processing and U Mobile has accepted your Device. If you want to know the estimated trade-in value before handing it in, you can proceed to any U Mobile store to find out the trade-in value for your device.
  6. Prior to trade-in, you must remove the SIM card and/or memory card in your Device (if any) along with any accessories and you must back-up any data that you wish to retain before handing in the Device to us for trade-in.
  7. You are solely responsible for removing all information and data from the Device. To protect your privacy, you acknowledge that before handing your Device to U Mobile for trade-in, you have erased all applications data, contacts, and personal data including but not limited to photos, messages, web browsing history, and/or passwords and other personal, confidential or sensitive data stored in your Device. U Mobile and its suppliers are not responsible for removing personal, confidential and sensitive information from the Device and cannot guarantee such information left on the Device will be deleted. If you fail to remove all personal, confidential or sensitive information from your device, U Mobile and its suppliers are not liable to you for any damages you may suffer if such information left on the Device is accessed.
  8. The Device that is accepted by us for trade-in will not be returned to you. All data from traded Devices cannot be recovered.
  9. U Mobile will only accept devices of certain models for trade-in. Kindly refer to www.u.com.my for the list of devices that U Mobile will accept for trade-in and the trade-in value.
  10. U Mobile does not accept CDMA devices or repaired devices but you do not have to submit the charger, accessories or box which was provided which you first obtained the Device.
  11. Trade-in may only be accepted if the Device fulfills the following criteria:
    1. The Device must be able to power on and off and battery is able to charge normally;
    2. IMEI no. can be detected;
    3. Screen is functional and not cracked;
    4. Activation lock and/or screen lock must be disabled (for iPhones, the "Find My iPhone" function must be disabled);
    5. Casing is not cracked and there are no missing or non-functional buttons; and
    6. The Device is not damaged by water or liquid.
    Despite the above criteria having been fulfilled, U Mobile is under no obligation to accept the Device that you submit for trade-in.
  12. Trade-in is only applicable with the sign-up of new U Mobile Postpaid service plan or Prepaid iPlan with devices (for selected models only) in U Mobile stores and is not exchangeable for cash. There will be no refund on the extra value if the trade-in value is more than the device price that you purchase at U Mobile, if any.
  13. The trade-in program is valid for such period as U Mobile may determine at its sole discretion.
  14. You may trade-in one (1) device only for one (1) new U Mobile Postpaid service plan with device that you sign up.
  15. In the event that you are found to be in breach of the Declaration and any of these Terms and Conditions, then without prejudice to any rights and remedies of U Mobile in law or under these Terms and Conditions, you are liable to fully indemnify U Mobile for all costs, expenses, loss and damage suffered due to the breach.
  16. U Mobile may change any of these Terms and Conditions by posting such changes on our website. It is your responsibility to check our website for such changes from time to time.
  17. To the extent permitted by law, U Mobile excludes all liability in connection with this trade-in. You agree to release U Mobile and its suppliers from and indemnify U Mobile and its suppliers against all liability (including negligence) for any personal injury or for loss or damage (including loss of opportunity); whether direct or indirect, special or consequential arising out of participation in this trade-in.
  18. The Declaration and these Terms and Conditions are governed by the laws of Malaysia. You agree that the Courts of Malaysia have jurisdiction over all matters arising from this trade in.
